Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of iComStay's website, mobile application, and services (collectively, the "Platform") operated by iComStay ("Company", "we", "us", or "our"). By creating an account or making a booking, you agree to these Terms.

2. Definitions

• "Guest" — a registered user who books accommodation through the Platform.
• "Hotel Partner" — a property owner or manager who lists accommodation on the Platform.
• "Booking" — a confirmed reservation made through the Platform between a Guest and a Hotel Partner.
• "Service Fee" — a fee charged by iComStay to Guests on each booking to cover platform costs.
• "Commission" — a fee deducted from the Hotel Partner's payout upon each completed booking.

3. Eligibility

You must be at least 18 years old to use iComStay. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into binding contracts. iComStay reserves the right to refuse service at its discretion.

4. User Accounts

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@icomstay.com if you suspect any unauthorised access.

5. Bookings & Payments

When you complete a booking on iComStay:

• You enter into a direct contract with the Hotel Partner for accommodation services.
• iComStay acts as an agent facilitating the transaction and is not a party to that contract.
• Payment is processed securely by Paystack. iComStay does not store card details.
• A non-refundable service fee of up to 2% is charged at the time of booking.
• Prices displayed are in the currency shown and include all applicable taxes unless stated otherwise.
• Booking confirmation is sent to your registered email immediately upon successful payment.

6. Cancellations & Refunds

Cancellation policies vary by property and are clearly displayed on each listing before you book:

• Flexible: Full refund if cancelled 48+ hours before check-in.
• Moderate: 50% refund if cancelled 5+ days before check-in.
• Non-Refundable: No refund on cancellation.

The iComStay service fee is non-refundable in all cases. Refunds are processed within 5–10 business days and returned to the original payment method.

7. Hotel Partners

Hotel Partners agree to:

• Provide accurate, current, and complete listing information including photos, amenities, and pricing.
• Honour all confirmed bookings at the agreed rate.
• Comply with all applicable Nigerian laws and local regulations governing accommodation and hospitality.
• Pay the agreed commission rate on each completed booking.
• Maintain adequate insurance for their property and guests.

iComStay reserves the right to remove listings that violate these standards or generate repeated complaints from guests.

8. Prohibited Conduct

You must not:

• Submit false, inaccurate, or misleading information
• Circumvent the Platform to make or receive direct payments that bypass iComStay
• Post fake reviews or manipulate ratings
• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Harass, threaten, or discriminate against other users or Hotel Partners
• Scrape, copy, or reproduce Platform content without written permission

9. Intellectual Property

All content on iComStay — including but not limited to logos, text, graphics, and software — is the property of iComStay or its licensors and is protected by Nigerian and international intellectual property laws. You may not reproduce or distribute any content without prior written consent.

10. Limitation of Liability

iComStay's liability for any claim arising out of or related to your use of the Platform shall not exceed the total amount you paid to iComStay in the twelve (12) months preceding the event giving rise to the claim. iComStay is not liable for the acts or omissions of Hotel Partners, or for any indirect, incidental, or consequential damages.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
